With the BCCI turning a Nelson’s eye to the happenings in the Bihar Cricket Association (BCA), advocate Abhinav Shrivastava sent a legal notice to the cricket board regarding non-compliance and willful and deliberate disobedience of the directions contained in the Patna High Court order CWJC No.13405/2021 dated 5.8.2024.
“The court had clearly and categorically indicated several instances of large-scale malpractices having been resorted to by the office-bearers of the BCA and despite the aforesaid information having been furnished to the concerned authorities under BCCI, no action was taken in the said respect by them,” says the legal notice issued by advocate Abhinav Shrivastava on September 9.
“That there are several other illegalities noticed by the court which are not only with respect to the functioning of the BCA but also a reflection on the apathetic and indifferent approach adopted by the concerned authorities under the BCCI as despite the aforesaid illegalities having been brought to their notice, no action in respect thereof was taken by the BCCI, which clearly indicated a complete failure of the BCCI while acting in the capacity of the regulatory body in respect of the game of cricket in the state of Bihar,” the notice states.
It also said that the court had stated that the BCCI “has to remain independent and act wherever any illegalities were committed by the BCA office-bearers and accordingly, BCCI has been directed to act promptly on the complaints made against the office-bearers of the BCA.”
However, the notice alleged that the BCCI has failed to take any action. “The aforesaid facts clearly cast a serious doubt on the conduct, intention and functions of the concerned authorities under BCCI and the chances of connivance between the office-bearers of the BCA and the BCCI can also not be ruled out.”
The notice said that if the BCCI did not take proper action against the erring BCA office-bearers, then “Aditya Verma would be constrained to take appropriate legal action against the wrongdoers in accordance with law.”
